1. Acceptance of Terms
By accessing or using the Wedding Website Builder platform ("Service"), operated by Hexer - Maksymilian Skórnóg, with its registered address at Kobyle 322, 32-720 Nowy Wiśnicz, Poland, NIP 8681999628, REGON 541556879, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
The Service provides tools for creating and managing wedding websites, including guest management, RSVP tracking, photo galleries, event schedules, and related features. We offer various pricing plans with varying feature sets.
3. Account Registration
To use certain features, you must create an account. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. You must provide accurate information and promptly update it if it changes.
4. User Content
You retain ownership of all content you upload to the Service, including photos, text, and guest information. By uploading content, you grant us a limited license to store, display, and process it solely for the purpose of providing the Service. You are responsible for ensuring you have the necessary rights to upload and share such content.
5. Privacy and Data Protection
We process personal data in accordance with our Privacy Policy and applicable data protection laws, including GDPR. Guest data you collect through the Service (names, emails, dietary preferences, etc.) is your responsibility as data controller. We act as data processor on your behalf.
6. Acceptable Use
You agree not to use the Service for any unlawful purpose, to upload harmful or offensive content, to attempt to gain unauthorized access to our systems, or to interfere with other users' enjoyment of the Service. We reserve the right to suspend or terminate accounts that violate these terms.
7. Payments and Refunds
The Service requires a one-time payment. All prices are displayed at the time of purchase and include applicable taxes. The Service is digital content supplied without a tangible medium. The Service is fully performed at the moment your wedding page is published - that is, made available to guests at its wedding address. Until publication, you may request a full refund within 14 days of purchase - simply write to us at marketing.hexer@gmail.com. By publishing your page before that deadline, you consent to the Service being fully performed and acknowledge that you lose your right of withdrawal at that moment.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience downtime. We are not liable for any loss resulting from temporary unavailability of the Service.
9. Limitation of Liability
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim. The above limitations do not exclude or limit liability that cannot be excluded under applicable law, including consumer statutory rights.
10. Complaints
If the Service does not work correctly or is not in conformity with the contract, you may file a complaint by contacting us at marketing.hexer@gmail.com. In your report, describe the problem and provide details that allow us to identify your account or order. We review complaints within 14 days of receipt and inform you of the outcome by the same channel.
11. Out-of-Court Dispute Resolution
As a consumer, you may use out-of-court methods of handling complaints and pursuing claims. In particular, you may use the EU online dispute resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr. Use of these methods is voluntary and requires the agreement of both parties.
12. Changes to Terms
We may update these Terms of Service from time to time. We will notify registered users of significant changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
